Clinton Judge Leonie Brinkema Blocks Trump DOJ’s $1.2B Anti-Weaponization Fund, Warns Against “Playing Possum”

CREW attorney Nikhel Sus contended that the settlement agreement establishing the fund remains legally operative, citing upcoming deadlines such as the June 17 deadline for establishing a five-member board and the July 17 deadline for funding transfers. “On paper, the fund is still a legally operating entity,” Sus argued. While Judge Leon ultimately accepted the government’s current assurances that the fund is moot, he cautioned that he can sanction attorneys for making false representations to the court and indicated he would continue to consider CREW’s request for a preliminary injunction, reserving the right to intervene if evidence suggests the administration is attempting to revive the fund.
